Welcome to niyapic! These Terms and Conditions (“Terms”) govern your access to and use of the niyapic application (the “App”) and any related services, including our website, mobile apps, and other products and services provided by niyapic (“Services”). By using niyapic, you agree to these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By accessing or using Niyapic, you agree to be bound by these Terms and our Privacy Policy. If you are using Niyapic on behalf of an organization, you represent that you are authorized to agree to these Terms on behalf of that organization.

2. User Accounts

2.1 Registration

• To use certain features of Niyapic, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration and to update such information as necessary to keep it accurate, complete, and current.

2.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2.3 Account Termination

• We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in any illegal or prohibited activity.

3. Use of Services

3.1 Content Sharing

• You agree to our Terms of Service. These terms prohibit the posting or sharing of any objectionable content, including but not limited to: hate speech, harassment, discrimination, threats, or any content that violates applicable laws. We also reserve the right to remove any content that we deem inappropriate and to terminate the accounts of users who violate these terms.

3.2 Prohibited Activities

• You agree not to:
  • Use Niyapic for any unlawful purpose or in violation of any applicable laws or regulations.
  • Interfere with or disrupt the operation of niyapic or servers.
  • Attempt to gain unauthorized access to niyapic’s systems or accounts.
  • Use niyapic to transmit any harmful, offensive, or disruptive content.
  • Engage in any activity that could harm, disable, overburden, or impair niyapic’s infrastructure.

3.3 Content Ownership

• You retain ownership of any content you create and upload to Niyapic. However, by uploading content, you grant us a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, display, modify, reproduce, and distribute your content in connection with the App and its services.

3.4 Data Removal

• To delete your data from Niyapic, Go to your profile page and tap ‘Delete Account’ . Confirm your decision to delete your data and unpublish your videos. Your account will be deactivated for 30 days. You can reactivate it within this period, but after 30 days, it will be permanently deleted.”
• To deactivate your account, Go to your profile and tap ‘Deactivate Account’. Confirm your decision. Your account will be deactivated, but you can reactivate it at any time.

4. Location Data

4.1 Collection and Use

• niyapic collects location data to provide location-enabled features. By using these features, you consent to the collection and use of your location data in accordance with our Privacy Policy.

4.2 Control and Permissions

• You can manage location permissions through your device settings. However, disabling location services may limit the functionality of certain features within Niyapic.

6. Disclaimers and Limitation of Liability

6.1 Disclaimers

• Niyapic is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that Niyapic will be error-free, secure, or uninterrupted.

6.2 Limitation of Liability

• To the fullest extent permitted by law, Niyapic, its affiliates, and its respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Niyapic.

7. Indemnification

You agree to indemnify and hold harmless Niyapic, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of Niyapic, your violation of these Terms, or your infringement of any rights of another party.

8. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of Niyapic after the changes are posted constitutes your acceptance of the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of Niyapic shall be resolved in the courts located in Texas, USA.
